The Collapse of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis triggered by the presentation of a new 28-point plan for achieving ceasefire appeared – momentarily – to have been stabilised. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: another massive barrage of missile and drone strikes on Kyiv.

The Rhythm of Negotiation and Warfare

The chain of conflicting incidents captured the bleak nature of the current period. By day, diplomatic battles are waged: optimistic declarations are released from multiple capitals. Considerable effort is allocated on restraining specific proposals. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the main instrument for achieving "peace".

After-Dark Attacks

As the offensive developed into the early hours of Tuesday, the current condition of Ukraine's exposure was laid bare. Ukraine is capable of detecting missile launches from across the border, a capacity afforded by current data. From vantage locations, Ukrainian air force fighter jets that had been deployed to intercept incoming guided weapons streaked across the sky – sophisticated military planes supplied to Ukraine by NATO members.

Shortly after, Kyiv's missile defense engaged: multiple launches fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, probably delivered by allied countries. Every launch creates sudden vibrations, shaking the windows. The moment of terror quickly becomes sober acceptance: possibly the hostile projectile won't hit its mark this time, preventing destruction from catastrophe and another blackout.

Ongoing Risks

Not long after, a large-caliber weapon opened up on a aerial vehicle close by, part of a mobile-fire group – probably Western-made equipment. Sadly, the projectiles didn't strike the hostile drone – it pressed on overhead toward its target.

Periodically, this persisted until dawn. Kyiv greeted the morning news: multiple fatalities, damage and heating outages in multiple buildings as a result of the night's assault. As typically, everyone still went about their day – living the war. But those full day demonstrated Ukraine's critical military reliance on Western support – a need that European nations are demonstrably unable to substitute in the near term.

Unsuccessful Negotiations

The 28-point plan from Washington generated strong feelings, discussion and profound anxiety – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and international summits.

Every new initiative from US leadership unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They manage the tension but never actually win the battle. This pattern will, certainly, endure.

Political Considerations

It is tempting to accuse specific actors of repeatedly advocating Kremlin's demands. But that does not seem to be the complete picture. US administration functions according to a principle well known to international relations experts: you cannot secure via talks what you have lost on the battlefield. The American government assumes that it is impossible to force Russia to relinquish the areas that it currently occupies in Ukraine's south or east.

The problem is that while acknowledging this situation, Washington does nothing to deter Moscow, through statements or actions, from thinking that the situation will not evolve additionally in its favour in the coming year.

Divergent Views

Therefore, the Kremlin is certain that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their incentive to sign a deal that does not give them the greatest potential benefit is close to zero. There may be numerous efforts to end hostilities, but they will persist as long as Russia's leader remains highly assured in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, gradually sacrificing lives and land but averting a complete military breakdown until conditions improve in its benefit.

Existing Situation

Realistically, there are no genuine requirements for a armistice. Now, individual motivations are becoming relevant: personal goals to negotiate peace and achieve global acclaim, and Ukrainian leadership's twin challenges – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unworkable, so that their priority does not shift toward internal issues. And although their objective will now be considerably more difficult after recent developments, it remains very improbable that this will alter their fundamental strategy.

These two forces are guiding negotiations.

Assessment and Future

It took a just a single week to terminate the proposed articles of the most recent proposal. Aggressive and erratic handling of the matter by US administration, opposition by Ukraine and the remaining European nations, along with calming attempts of negotiators, and finally, latest revelations, all did their job.

While new proposals based on previous concepts are imminent, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and show particular unwillingness to alter the situation, if they stand together and strengthen their defence capabilities at a much faster pace. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the foreseeable future, mainly require continued Western support.
